Our terms and conditions for working together.

1. Agreement to Terms
By accessing or using the services provided by Sjenkie B.V., trading as Yellow House Digital (Chamber of Commerce NL: 60310030), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Sjenkie B.V. provides digital platform development, AI solutions, automation services, and related consulting services. Specific deliverables, timelines, and pricing are agreed upon in separate project agreements or contracts.
3. Client Obligations
Clients agree to:
- Provide accurate and timely information necessary for project completion
- Review and approve deliverables within agreed timeframes
- Make payments according to the agreed schedule
- Comply with applicable laws and regulations
4. Intellectual Property
Unless otherwise agreed in writing:
- Upon full payment, clients receive ownership of custom-developed deliverables created specifically for their project
- Sjenkie B.V. retains ownership of pre-existing materials, frameworks, tools, and methodologies
- Sjenkie B.V. may showcase completed projects in portfolios and marketing materials unless confidentiality is agreed upon
5. Payment Terms
Payment terms are specified in individual project agreements. Standard payment terms include a deposit before work begins and final payment upon completion. Late payments may incur interest charges as permitted by Dutch law.
6. Project Timeline
Project timelines are estimates and may be adjusted based on scope changes, client feedback delays, or unforeseen circumstances. We commit to clear communication about any timeline changes.
7. Confidentiality
Both parties agree to keep confidential information shared during the engagement private and use it only for the purposes of the project. This obligation survives the termination of the agreement.
8. Warranties and Disclaimers
We warrant that services will be performed with professional care and skill. However, we do not guarantee specific business outcomes or results. Services are provided "as is" except as specifically warranted in writing.
9. Limitation of Liability
To the maximum extent permitted by Dutch law, Sjenkie B.V.'s liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
10. Termination
Either party may terminate the engagement with written notice. Upon termination, the client is responsible for payment for work completed up to the termination date. Materials and rights transfer only upon full payment.
11. Modifications
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
12. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in the Netherlands.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
14. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
